1. Acceptance of Terms

By downloading, accessing, or using KidChef ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

If you are a parent or guardian creating an account on behalf of a child, you agree to these Terms on behalf of yourself and your child.

2. Description of Service

KidChef is a mobile application and website that helps families cook together by converting recipes into kid-friendly, step-by-step instructions. The Service includes:

  • Recipe importing and storage
  • AI-powered recipe conversion for children
  • Kid profiles with age-appropriate settings
  • Cooking mode with step-by-step guidance
  • Safety warnings and allergen detection

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Be at least 18 years old (or the age of majority in your jurisdiction)
  • Accept responsibility for all activities under your account

4. Child Accounts and Parental Consent

KidChef is designed for use by children under parental supervision. By creating a kid profile, you represent and warrant that:

  • You are the parent or legal guardian of the child
  • You consent to the collection and use of your child's information as described in our Privacy Policy
  • You will supervise your child's use of the Service, especially during cooking activities
  • You take responsibility for your child's safety in the kitchen

5. Kitchen Safety Disclaimer

IMPORTANT: Cooking involves inherent risks including burns, cuts, and other injuries.

While KidChef provides safety warnings and age-appropriate guidance, it is not a substitute for adult supervision. You acknowledge and agree that:

  • Children should always be supervised by an adult while cooking
  • Parents are responsible for determining appropriate kitchen equipment and tasks for their children
  • KidChef's safety warnings are guidelines, not guarantees of safety
  • You assume full responsibility for kitchen safety when using the Service

6. Subscriptions and Payments

KidChef offers free and paid subscription plans. For paid subscriptions:

  • Payment is charged to your Apple ID or Google Play account
  • Subscriptions automatically renew unless canceled before the renewal date
  • You can cancel anytime through your device's subscription settings
  • Refunds are subject to Apple/Google's refund policies

We reserve the right to change pricing with notice. Price changes will not affect current subscription periods.

7. User Content

You retain ownership of recipes and content you create or import. By using the Service, you grant us a license to store, process, and display your content to provide the Service to you.

You agree not to:

  • Upload content that infringes on others' intellectual property rights
  • Share inappropriate or harmful content
  • Use the Service for any illegal purpose
  • Attempt to reverse engineer or modify the Service

8. Intellectual Property

The KidChef name, logo, and all related content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without prior written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY RECIPES, INSTRUCTIONS, OR CONTENT PROVIDED THROUGH THE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless KidChef and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may terminate your account at any time by deleting it through the app settings.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
